Terms of Service

By accessing or using TrailSnail (the "Service") you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

These Terms constitute an agreement between you and Carlo Cannarsa, an individual based in Italy operating TrailSnail (the "Operator", "we", "us" or "our"). For contact details see Section 19 below.

TrailSnail is currently operated as a personal, non-commercial project by a private individual based in Italy. It is NOT a registered company, business or VAT-registered activity. There is no professional support team, no service-level agreement, no guaranteed uptime and no commercial liability insurance behind the Service.

Practical consequences:

• The Service may be paused, modified or discontinued at any time. Where reasonably practicable, we will make reasonable efforts to provide advance notice of significant interruptions or discontinuation.
• Bugs, downtime, data loss or inaccurate suggestions can happen. Because the Service is provided free of charge and on a best-effort basis, you are generally not entitled to refunds or compensation except where required by applicable law.
• Response time to support requests is best-effort, typically days not hours.
• Any affiliate commission earned through external referral programs is below the Italian threshold for occasional ancillary income and does not transform TrailSnail into a commercial activity.

By using TrailSnail you acknowledge this status. If we ever transition TrailSnail into a registered business (for example by opening a VAT number or incorporating), we will update this section and notify users.

TrailSnail is a trip-planning tool that automatically composes day itineraries for the destination, dates and interests you provide. It combines free walking tours, paid activities and free points of interest sourced from third-party providers into balanced suggestions.

TrailSnail is not a tour operator, travel agent, ticket reseller, or transport provider. We do not book, sell, or guarantee any tour, activity, accommodation, or transport. Bookings, payments, refunds and the actual delivery of any experience are handled directly between you and the relevant third-party provider, subject to that provider's own terms.

You must be at least 18 years old to use TrailSnail. By creating an account you confirm that you meet this requirement and that the information you provide is accurate. This minimum age aligns with the full contractual capacity required under Italian law and with the age policies of the booking platforms TrailSnail links to.

Authentication is handled by a third-party identity provider on our behalf. You are responsible for keeping your account credentials secure and for any activity under your account. Notify us promptly of any unauthorised use.

You agree not to, except where permitted by applicable law:

• use the Service in any way that violates applicable laws or third-party rights;
• scrape, crawl or otherwise extract data from the Service except via the documented user interface;
• attempt to disrupt the Service, bypass rate limits, or interfere with other users;
• reverse-engineer or attempt to extract source code from compiled artefacts, save as expressly permitted by mandatory interoperability or other statutory exceptions;
• upload content that is unlawful, infringing, defamatory, or that contains malware;
• use the Service to generate spam, automated booking attempts, or competing AI training data.

You retain ownership of the trip preferences, notes and itineraries you create on TrailSnail ("Your Content"). You grant us a limited, worldwide, royalty-free licence to host, store, reproduce and display Your Content for the sole purpose of operating the Service for you.

We do not sell Your Content. We do not use it to train AI models. We may pass minimal context (destination, dates, interests) to a third-party AI provider so it can generate your day plans. Personal data shared with AI providers is processed in accordance with our agreements with those providers and appropriate contractual and technical safeguards. The current list of processors and what they receive is described in our Privacy Policy.

TrailSnail displays tours, activities and points of interest from third-party providers. Pricing, availability, descriptions, schedules and the actual quality of any experience are controlled by those providers, not by us. We do our best to surface accurate information but make no warranty as to its correctness or timeliness.

Some external links to third-party booking platforms include affiliate identifiers. If you book through one of these links, we may earn a small commission at no extra cost to you. This commission helps keep the planner free. Affiliate relationships do not influence our recommendations or the order in which activities are presented. Ranking is based on factors such as relevance to your interests, location proximity, provider ratings and time-slot fit.

The itineraries, recommendations and information generated by TrailSnail are provided for informational purposes only and should not be considered professional travel, legal, financial, medical or safety advice. You are solely responsible for verifying details — including opening hours, prices, accessibility, visa requirements, weather, safety advisories, and any provider's terms — before relying on any plan generated by the Service.

We do not guarantee that the Service will always be available, uninterrupted, secure or error-free. The Service is delivered on a best-effort basis and may be temporarily unavailable for maintenance, upgrades, third-party outages, or for reasons outside our reasonable control.

TrailSnail, its software, source code, branding, name, logos, design, layout, editorial content and the structure and presentation of the Service are owned by the Operator or licensed to it, and are protected by intellectual property laws. Nothing in these Terms transfers ownership of any of the foregoing to you. You may not copy, redistribute, sublicense, sell or exploit the Service or any part of it, except as expressly permitted by these Terms or by applicable law.

You retain ownership of Your Content as set out in Section 6.

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. Travel involves risk that is outside our control.

To the maximum extent permitted by applicable law, the Operator will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Service. Our aggregate liability for any direct damages will not exceed the amount you paid to use the Service in the twelve months preceding the claim — which for a free planner is typically zero.

This limitation applies only to the maximum extent permitted by applicable law. Nothing in these Terms limits liability that cannot be excluded under applicable consumer-protection law, including statutory rights you may have as a consumer in the European Union, nor liability for death, personal injury caused by negligence, or fraud.

You can stop using the Service at any time and delete your account from the account settings. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates legal or operational risk for us. Upon termination, sections of these Terms that by their nature should survive — including ownership, disclaimers, limitation of liability, intellectual property and the governing-law clauses — will continue to apply.

If any provision of these Terms is held by a competent court or authority to be invalid, illegal or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or, if such modification is not possible, severed from these Terms. The remaining provisions of these Terms will remain in full force and effect.

Our failure to enforce any provision of these Terms, or any delay in doing so, will not be construed as a waiver of that provision or of our right to enforce it on any future occasion. No waiver is effective unless made in writing.

These Terms, together with our Privacy Policy and any documents expressly incorporated by reference, constitute the entire agreement between you and the Operator regarding the use of the Service, and supersede any prior agreements or understandings.

We may update these Terms from time to time. Material changes will be communicated through the Service where appropriate. The updated Terms will apply from the effective date indicated at the top of this page. Where required by applicable law, we may ask you to expressly accept the updated Terms before they take effect.

These Terms are governed by the laws of Italy, without regard to its conflict-of-laws principles. Any dispute will be brought before the competent courts of Italy.

For consumers based in the European Union, mandatory consumer-protection rules of your country of residence continue to apply, and you may bring proceedings before, or be sued only before, the courts of your country of residence to the extent required by such rules. Nothing in these Terms deprives you of the protection of mandatory provisions of consumer law.
